Terms of service

General Terms and Conditions (GTC)

1 Scope

These General Terms and Conditions (hereinafter “GTC”) apply to all legal transactions concluded via the online shop www.e-car-shop.ch (hereinafter “online shop”). The online shop is operated by e-trends GmbH (hereinafter “ETR”).

ETR reserves the right to amend these GTC at any time. The version of the GTC valid at the time of the order shall be decisive. Any terms and conditions of the customer that conflict with or deviate from these GTC shall not be recognized.

The offer is directed exclusively at customers with a place of residence or registered office in Europe.
Deliveries are made exclusively to addresses in Europe.

The offer is valid as long as the product is available in the online shop and/or while stocks last.

For age-restricted products, the customer confirms compliance with the statutory minimum age requirements by placing the order.

Orders in quantities that are not customary for household use may be rejected without stating reasons.


2 Information

2.1 Product and price

Product images are for illustration purposes only and are non-binding.

All prices stated in the online shop are final prices and include all taxes, any advance recycling fees (vRG), packaging costs and other statutory charges.

ETR reserves the right to change prices at any time. The price displayed in the online shop at the time of the order shall be decisive.

Chargeable additional services (e.g. installation, disposal, warranty extensions) are shown separately in the shopping cart and on the invoice.


2.2 Availability and delivery time

ETR endeavours to provide up-to-date and accurate information on availability and delivery times. Due to production or delivery bottlenecks, this information may change. All such information is provided without guarantee.


3 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer. The purchase contract is concluded as soon as the customer places an order via the online shop, by telephone or by e-mail.

The automated order confirmation merely confirms receipt of the order and does not constitute a guarantee of availability or delivery.


4 Delivery date

If ETR or a supplier is in default of delivery, the customer (with the exception of special orders) shall have the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date. Any payments already made will be refunded. Further claims are excluded.


5 Delivery

The delivery and collection options offered in the online shop apply.

Risk passes to the customer when the goods are handed over to the shipping service provider. A delivery documented in the shipment tracking system shall be deemed proper delivery, provided there are no obvious irregularities.

If a shipment cannot be located despite delivery confirmation, ETR will assist the customer in initiating an investigation with the shipping service provider.

If the customer does not accept the delivery or refuses it without justified reason, the customer shall bear the resulting costs (e.g. return shipping costs, renewed shipping costs).


6 Duty to inspect

The customer must check the delivered or collected products immediately for correctness, completeness and damage.

Defects, incorrect or incomplete deliveries must be reported to ETR within 5 calendar days of delivery or collection. After expiry of this period, the products shall be deemed accepted, unless there are hidden defects.


7 Warranty

ETR grants a warranty of 2 years from delivery for freedom from defects and proper functioning of the products.

The warranty service is provided at ETR’s discretion by:

  • Repair

  • Replacement with an equivalent product

  • Replacement with a new product

  • Credit at the current value (up to a maximum of the purchase price)

  • Reduction of the purchase price

Wear parts (in particular batteries, rechargeable batteries, light sources, cables, adapters, etc.) are excluded from the warranty, insofar as the defect is due to normal use or wear and tear.

Any further statutory warranty claims are excluded to the extent permitted by law.


8 Liability and exclusion of liability

Liability is governed by the applicable statutory provisions. However, ETR shall in no event be liable for:

  • slight negligence

  • indirect or consequential damage

  • consequential damage and loss of profit

  • failure to realize savings

  • damage resulting from delay in delivery

  • acts or omissions of auxiliary persons

In particular, there shall be no liability in the event of improper use, incompatible accessories, lack of maintenance, unauthorized modifications or force majeure.

Some products – in particular vehicle accessories – do not have a general operating permit (ABE) or are subject to registration. Responsibility for permissibility, proper installation and any required approvals lies exclusively with the customer.


8.1 Special provisions for electric charging infrastructure

Products in the field of electric charging infrastructure (in particular mobile charging devices / ICCB, CEE adapters and connection cables as well as wallboxes) may only be operated on suitable electrical connections that have been professionally installed, protected and tested, and that are equipped with a properly functioning residual current protection device (FI / RCD).

Mobile charging devices are intended exclusively for occasional use and are not a substitute for permanently installed charging infrastructure (e.g. wallbox).

The customer is responsible for compliance with the applicable statutory, technical and local regulations (e.g. protection, socket type, cable dimensioning, residual current protection) as well as for proper operation in accordance with the product description and operating instructions.

ETR accepts no liability for damage resulting from improper installation, missing or insufficient residual current protection, overloading of the electrical installation, use of unsuitable or non-standard-compliant connections (e.g. sockets, extension leads, adapters) or improper use.


9 Payment

All payments are made in the currency displayed in the online shop.

Only the means of payment offered in the online shop are accepted. For payment by credit card or other instant payment methods, the charge is made when the order is placed.

Cash payment is only possible upon collection and only if the amount is exact. There is no entitlement to change.

Any currency conversions, fees or exchange rates are determined by the respective payment service provider and are outside ETR’s sphere of influence.


10 Changes to or cancellation of orders

Orders are binding. Changes or cancellations may be accepted at ETR’s discretion.

The first full cancellation at the customer’s request is free of charge. For further cancellations, a handling fee of 10% of the order value may be charged. In special circumstances, a processing fee of up to 20%, but at least CHF 60.–, may be charged.


11 Return of non-defective goods

ETR grants a right of return of 14 calendar days from receipt of the goods.

The return must be registered in advance by form, e-mail or post. Return shipping costs are borne by the customer. The goods must be returned complete, undamaged and in the original packaging. If the original packaging is missing, a processing fee of 10% of the product purchase value will be deducted.

The refund will be initiated after receipt and inspection of the return. The actual crediting depends on the respective payment provider.


12 Repairs outside the warranty

Costs for repairs outside the warranty as well as inspection and shipping costs in the case of non-identifiable defects shall be borne by the customer.


13 Other provisions

13.1 Unassignable returns

Unassignable returns will be stored for six months and then disposed of.

13.2 Data protection

ETR’s privacy policy applies. Personal data may be used for ETR’s own marketing purposes within the framework of statutory provisions.

13.3 Severability

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.

13.4 Place of jurisdiction and applicable law

Exclusively Swiss law shall apply. The place of jurisdiction is Dietikon or the place of residence of the consumer.
